The Sad Truth About Collecting Judgments From Lawsuits

Many people such as myself have filed lawsuits as a last resort to counter the damages the defendant(s) caused.  After trying everything within my power to end the dispute, I filed.  I won a judgment last year for $25,136 that is really nothing but a piece of paper, even less significant than an IOU.  I'm quite certain the judgment is noncollectable unless the defendants win the lotto.

When I filed two defamation lawsuits in 2009, I had no intention of ever collecting a dime.  I knew that, unless the defendants had a nice paying job or owned a home or an over the top expensive vehicle, there was virtually no way of collecting a judgment.  Procedurally I could order a writ of examination and request the defendant's financial information and bank accounts, but by the time I collected the information, the accounts would be empty.  Moreover, any IRA/401k retirement accounts are untouchable from collection from judgments.  Of course, I could also place a garnishment on wages, but that wasn't an option for an independent contractor and low wage earner.  Even if I obtained a wage garnishment, the amount would be restricted to 10-15% of the paycheck.

The sad truth is that if people with no real property or employer don't want to pay you anything in a lawsuit you generally won't be getting anything. Such is why lawsuits should only be a last resort because they're time consuming and expensive.  Here's a hint: lawyers generally file lawsuits only after they research to find the defendants have considerable assets. 

I once learned the hard way from a Small Claims Court case, if someone doesn't want to pay you, unless they're wealthy, you have virtually no hope of getting your money. Here's another little hint, people don't have to pay if they don't want to. They can move, quit their job if they have one, and avoid paying.  Unless the issue is child support, there's virtually no hope.

Unless the defendant has real assets and a good paying job, the court's essentially acting like Bugs Bunny in this Looney Tunes episode in its awarding a mirage judgment.  It's all yours now, take it!

The Last Resort Option

When you realize you're virtually helpless to collect your judgment, you might want to consider offering a reduced pay off amount and settlement agreement.  For instance, I'd be willing to negotiate a $1,000 payoff for the $25K dispute but see no reason why the defendants think they should pay me anything.   What for?  What would they get out of paying me one cent?  The court system's a joke designed for the big game players, not for people like me. 

Imagine if I harassed the defendants for my money, what could they do?  First, they'd likely file a complaint for unlawful harassment under certain circumstances and it all could backfire on me, then I could be sued.  They may even decide to eventually leave the State of California.  I'd have to invest hundreds, if not thousands, of dollars to track them down using a private investigator but might never locate them again.  They could possibly go undetected for years unless they opened a new banking account or credit card account in the new state.

The only time lawsuits really affect people is if they have a lot of money to lose.

Tiny House Trend Emerges As U.S. Property Values Face Decade Long Stagnation

A few months ago at a loan signing someone who works as a Vice President at a commercial loan banking institution told me her refinance papers took six months to process. "There must be a huge backlog, so you should get tons of work coming your way soon," she commented.

Another banking professional told me the banking loan industry doesn't expect property values to rise much on national average for the next 10 years.  The banking executive said "I'm taking a huge loss on this property that dropped to half its former value and the buyer's making a killing." He added, "there's a huge inventory of foreclosed homes on the market contributing to the mess."

The Reason Foundation's article Housing Market in Total Freefall, Anthony Randazzo reports sobering news in the latest MacroMarkets Report.

 "Overall, the March expectations data are the most pessimistic collected to date, and added that after weak performance in the last quarter of 2010, actual home prices at the national level are now less than 1% away from establishing a new post-crash low." And since that isn't cheery enough he added, "Many more experts are now projecting a double-dip after witnessing the double-dead cat bounce that came in the wake of expired government stimulus programs."

The graph tells the story of a peak and decline in property values and projections to 2016, not even half of where it was.  This means many homes bought when the market peaked dropped in value significantly and won't regain their value for another decade or more.

Important information, February's sales figures were the lowest since the years of JFK. This is getting real bad folks!

I follow a real estate attorney blog, attorney Matthew Weidner, P.A. and a few days ago he posted The Foreclosure Mess is Amerika's Nuclear Disaster.

I figure all this can only mean one thing; a majority of Americans won't be able to afford large homes anymore.  Enter the emerging tiny house trend.  I read about these tiny houses a couple years ago when the market crashed in 2008.  I think this will be a growing trend as the housing crisis gets worse, especially among young people who have the energy to live that kind of lifestyle.

I guess the days of large houses and the American dream for many are coming to an end.  Maybe a few can still afford these kind of homes they call Tiny Houses.  This video shows one that's 89 square feet.

Reality Check: Most U.S. Politicians Nothing But Criminal Parasitic Clowns

Metaphorically, placing one's hope in today's U.S. politicians is much like placing one's hope in clowns from Ringling Bros. Barnum & Baily's Circus to save the day.  The reason many people go into politics much of the time is they don't want to work for a living except to act as parasites feeding off the tax payer system as their host.

Anyone whose been around long enough knows politics is for bully cowards who manipulate and spin reality to their favor.  With a few exceptions such as Ron Paul, it's easy to summarize the reason for the mess America's in economically is because greedy criminals are running things.  Americans really need to wake up the government is run by criminals and their game is designed to rob them in every way possible. I came to a personal revelation that I will no longer be listening to any politician believing a word of what they say nor participating in their game whatsoever.  In the last election I didn't vote for any President, leaving the choice blank.  I would have chosen a candidate for President but couldn't vote for Ron Paul because he was a Republican.   I've never voted for a Republican in my entire life but I'm no longer voting for Democrats either.  I've since learned both parties are two sides of the same coin and that the Dems simply lie better than Republicans. At least with the Repugs you know what you're getting, a rotten bunch of meat.  With Dems, they dress up the rotten meat to make you think it's good for you so you don't really know what you're getting with their slick marketing campaigns.

What this comes down to for me personally is that I will no longer be giving any attention to politicians in the United States and their con game.  These politicians are a joke, nothing but a bunch of lame con artists who use the media to obtain their goals they otherwise wouldn't achieve in their personal lives.  These men and women in government have literally destroyed our country with their deliberate criminal traitorous activities. Who really is that man, Obama? I don't know him and that's the reality. I can't help it if my fellow citizens are naive and suffer from television addiction and belief systems enabling them to support such a corrupt government as if they're cheering a baseball team.  Americans have become self-destructive by continuing on this path of supporting lying con artists and a two party system while believing whatever the major media tells them. It's really a sad tragic thing to observe this all happening.

Americans' REAL Enemy Comes Into Focus - U.S. Government Most Hated By Them

In spite of all the fear mongering to try and convince Americans that boogie men terrorists are responsible for America's woes, a recent Gallup poll released in late August, 2011 shows how much Americans despise their own U.S. Federal Government.  The data shows the downward spiral for the a/k/a "criminal domestic network" has been going on for quite some time as Americans are coming to terms they have no control over what their mafia thug government is doing to destroy their country.

Bush's job approval rating and rising concerns about the Iraq war and the economy. The poll also went on to state Congress has the lowest approval rating in Gallup history.

Oh my, I wonder what has caused Americans to so hate their own government once viewed as the best in the world?  The problem likely has to do with how the Feds have gradually been redirecting their operations in favor of a world based economy while turning against Americans on all fronts.  This trend of the U.S. Federal government's traitorous acts has clearly been taking its toll on American's patience causing historic lows in the poll.

There's no doubt the recent news that America's fallen in the world economic ranking to #5 only makes Americans angrier at their incompetent power hungry war mongering government.

The Gloves Are Off! U.S. Federal Government Seeks to Destroy American Workforce

In view of the recent SWAT team raid on Gibson USA, one of the last remaining American manufacturers that added 580 employees the past two years, evidence has surfaced what the raid was really all about.  The evidence supports my previous post disclosing how the U.S. Federal Government's working hard to cause the extinction of American manufacturers to ship American jobs overseas.  Who really thinks that after the U.S. Federal Government was taken over by world government interests they would announce it to the world?  Think about it, crooks don't come in and announce they're robbing you, they just do it at a convenient time when you're sleeping, away or murder their victims. The criminals would never expose their operation by announcing "we've taken over your country and are doing with it as we so please!"  Clearly, the clever thieves would incrementally dismantle America below the radar while the major media distracts Americans with shallow political rhetoric, celebrity gossip, sports and entertainment.

You can be rest assured President Obama's paying nothing more than lip service to American jobs in order to continue to distract from the fact a criminal cabal cloaked in the Federal Government is attempting to dismantle the last of America's manufacturing base.  President Obama could give a rats behind about America jobs, he's one of them!  So is Rick Perry, one of them! So is Bill Clinton and Al Gore, one of them who supported NAFTA former Presidential candidate Ross Perot who claimed would cause a "giant sucking sound" of American jobs to be sent overseas.

When are Americans going to finally wake up the crooks have taken over and are at the helm?

U.S. Postal Service Issues Dire Warning of Potential Impending Collapse

The crooks in the U.S. Federal government sure can conduct fraudulent wars, SWAT team legitimate American business enterprises such as Gibson USA, and even put on a show for the dramatic hunt and execution of former U.S. CIA propped up dictators abroad.  With all of these incredible displays of power, why can't the U.S. Federal government run its own U.S. Postal service competently?  Maybe it's because the American people's mail service is a low priority to their own government.

The U.S. government has some of the most advanced military technology in the world that can send predator surveillance drones and put satellites into space. Again I ask, in view of these tremendous feats, why can't the government do something as simple as manage the people's U.S. Postal Service? I'd like to bring the reader's attention to a dire warning issued today regarding a $9 billion deficit and acknowledgment there's a crucial September 30th deadline:

A national USPS spokesperson stated "It would come to the point where the postal service would have to close its doors, but we continue to work with congress and expect there will be a solution eventually," said USPS Spokesperson Yvonne Yoerger. It should be obvious to many by now that Americans are put on a low priority list by their own Federal government, let there be no doubt.  All signs have been pointing to the continual gutting of America's manufacturing and jobs infrastructure in favor of building a world government focused on cheap slave labor wages offered by communist based super powers such as China.

Already stressed over their staff cutbacks, the U.S. mail employees are also facing the potential of losing their pension payments due to mismanagement by the Federal government.  Clearly, the U.S. Federal government can do so much for itself and military that includes invading sovereign countries for decade long occupations, while it can't do the simplest things effectively for the American people. It says a lot, that people shouldn't be buying the con game of these phony politicians anymore.

At the very least, there will likely be no more Saturday mail services and fewer locations to drop off one's mail in the future.  The possibility exists the U.S. Postal service could even close its doors all together. Imagine the chaos that would ensue from such an action affecting businesses across the board.  The Feds are great at invading countries on behalf of the U.N., terrible at managing basic services for the American people.

A spade's a spade is a spade, is a nightmare.  The Feds clearly don't work for us anymore.

The Temple of Self-Worship Is Short Lived - *Poof!* God's Back In My Life

I'm beginning to finally understand the problems people develop for partaking in the false religion temple of self-worship.  I was one of those people, it's an easy trap to fall into because it makes one's life much easier and less challenging.  Suddenly, there is no God, Satan and Lucifer to complicate one's life let alone Sunday church visits to deal with. Like magic, *poof!* God no longer exists because you say so while peacefully meditating it all away into a state of denial bliss. You thus follow no particular spiritual based rules except what you as a self appointed god decide.  You might as well open a the book of self-worship because you do it every day by choosing to disregard God's natural spiritual laws.  In essence, this chosen path turns a human being into a self-appointed void of nothingness in the spiritual world, prone to demonic attacks for Satan's twisted schemes thus having no real authority to affect or change anything.

Appointing yourself a god of your own temple of self-worship, you can also sit in judgment of orthodox religions as being outdated, corrupt and find all kinds of excuses to crucify Jesus Christ all over again. Being free of an alleged oppressive guilt based God, you can go on your own research expedition to justify your abandoning the Bible by finding various works claiming there are errors in the holy scriptures as you seek out Self Realization Temples worshiping nothing as I did in the 1980's near Malibu, CA.

I've been through phases in life of hating Christians and then gradually coming over to being agnostic after a few years of atheism.  I became an atheist in the late 1990's when I was on board with human evolution science trends.  Year's later I've eventually came back to accepting a Christian God in spite of the fact Christians can be so obnoxious, shallow and dumb. At least they're trying! There's no real justification to completely disregard what the Bible has to say if one can even find one sentence to help understand there's a bigger picture in life's purpose.  The sad thing is, Satan often quotes scripture so one must have knowledge to understand discernment in order to recognize the spirit of God behind it.

The main thing that drove me away from the Bible and Christians years ago was their insane fixation over homosexuals and abortion.  I've since come to learn over the years, abortions and birth control are just another way of playing god, making a decision to prevent a life from entering the world.  Fifty million abortions in America are what have really caused the U.S. government to allow millions of third world immigrants to enter the country for cheap labor.  Had Americans not had those abortions, there would be an American based labor force for manufacturing jobs the U.S. government would have been required to support. Instead, the government has encouraged allowing millions of immigrants to enter the country in its long term plan to collapse America's infrastructure into a world government.  Therefore it can be deduced this spiritual weakness in allowing abortion and unlimited birth control as a way of life in America has contributed to the government doing whatever it wants years later in its belief we have no spiritual dominion over our own country any longer.

The fact is, when I was younger Christians always made me feel like an idiot and humiliated me a lot in my 20's. The women called out demons from me and did the "blood of Jesus" rituals.  They were often ridiculous such as calling out the alleged demon of David Bowie while delving into my past and privacy.  I strongly disagreed with their emotional abuse of little children. While I disliked a lot of what Christians did, I later learned they were right about many things, such that Satan and Lucifer (two different entities) are real that one can't remain "neutral" over.  Once you acknowledge evil is real as a spiritual based forced, you can easily accept there's an opposing living God to save you from its grasp.

I continually experience people in the self-worship godless "I'm my own god" mode networking to protect their own interests who seek to destroy my life one way another.  For instance, as I recently posted, Judge Robert Longstreth hates God as an atheist. This San Diego judge, who's considered an anti-Semite in the community, made statements against Christians and Jews in his last campaign to retain his bench appointment. See Anti-Semitic Judges Win in San Diego - Six More Years to Destroy Children and Families - Crispe.org.  This is the same judge who facilitated the complete disregard of me while favoring and rewarding an obviously troubled demon possessed man who refuses to end his three year obsession and harassment. These men are motivated by the fact I don't worship or bow down to their god like powers in their taking advantage of my neutral position over God.  I was once like them decades ago, so I understand where they're coming from. One can easily observe how celebrities live off the energy of their cult followers, such as Lady Gaga an obvious self-worshipper.  

The Demon Possessed Have Driven Me Back To God!

What's helped me come back to God is no great feat since the godless have driven me to it with their evil demonic powers that seemingly never end. I've witnessed some really horrifying things of the lengths their hatred and lust for power takes them for my not bowing down to them. I wouldn't be surprised if there's even some murder plot under consideration.  I used to worship certain people as idols while being a great host for self worshipping parasites to plug into.  I was never equal in these people's eyes, they enjoyed my putting them above God handing over a piece of my life to be used for their personal conquest and glory in some way. That's how Satan's power works to disrupt and destroy all lives and souls he possibly can. 

In retrospect, fundamentalist Christians especially can do a lot of damage to others by being so forceful pushing their beliefs on those who aren't ready.  Regardless, those who have a heart for God will eventually come around as I have.  I still maintain some of the things in the Bible are so silly while I can't stand the hypocrisy it breeds. I will simply come to terms with God in my own personal quiet way. I won't be preaching to others or selling religion like an Amway distributor.  What this all means is that I'm going to start reading and applying the Bible to my daily life again except the Old Testament which I will be using  for its historical background. I will also be praying.

Once I accepted God back into my life, I've had no fear of death. I'm no longer afraid to die!  Though Satan and Lucifer have dominion in this world, their alien powers are limited to it and the hellish dimension where demonic spirits run wild.  Those with a guilty conscience or who remain in denial over God's existence and their evil activities in this world have condemned themselves to hell, which does indeed exist in the afterlife.

The spineless scoundrels, who so easily send young men and women to their deaths in fraudulent wars that kill innocent people abroad, can't even face the public's wrath for their actions!  A politician's worse nightmare is having to face the anger of a betrayed American public.

This leads me to one last thought, that of the Statue of Liberty.

I bet many Americans didn't know the Statue of Liberty was originally designed and intended for Egypt did they?  Egypt didn't want the statue which was later altered for America's use. I think all this points to America's foundation as a country in question in its being quickly disassembled from within by a traitorous Federal government aligned with world government interests. It's quite possible this was all planned long ago by a secret society, primarily among the freemasons, who have been strongly implanted in U.S. government's history.  Even George Washington was a freemason!  Freemasons are said to be responsible for the Statue of Liberty's construction and hidden meaning symbolism. San Diego Judge Robert Longstreth's Fruits of Labor Evident

Last year a Judge Robert Longstreth in San Diego East County Superior Court aided and abetted a highly problematic person in denial influencing an unfair outcome by disregarding me altogether.  This person continues to harass my business with recent Rip Off Reports and Scam Reports after an intense 3 years of trying to get him to leave me alone. He was also awarded a disproportionate unfair amount of money for legal fees since he was largely self-represented over a case I filed in 2009. Judge Longstreth was campaigning at that time to retain his appointed bench that was being challenged due to many complaints filed against him by the public.  Under the circumstances, Judge Longstreth would obviously only be supporting a local San Diegan, that's how politically shallow this judge is, that he even acted as an attorney on behalf of the defendant.  The judge acted as a mediator to argue why the defendant had to drive 16 miles to the central court while I had to travel 500 miles summoned by his court over satire based articles written 6-12 months prior to the lawsuit. This judge also threatened me with future consequences for my having filed a lawsuit against someone he considered to be the "wrong man". 

So if I'm such a dangerous person, why harass such a person for money?  For instance, I'm not bothering to collect the $25K judgment I was awarded last year because the guy I got an RO against is truly dangerous.

Hollister Police Sergeant Charged With $102K Embezzlement

In a follow-up to yesterday's shocking SF Giants embezzlement post, it sure seems like everyone wants a piece of the embezzlement action.  There are just endless stories posted on Marquet's International's Fraud Talk Blog I rely on when I'm extremely busy.

Read and weep over these pathetic individuals who were motivated by greed. Always remember, if this is what a few average employees do, imagine what the professional politicians in the U.S. government get away with due to their dangerous criminal networks that shield them?
  

Ray Wood, 53, of Hollister, California, has been charged with embezzling some $102,000 from the union that represented the Hollister Police Department where he had served most recently as a sergeant.  Authorities accuse Wood, who was president of the union, of siphoning off funds from the department over a period of nearly 7 years, beginning in March 2004 until December 2010.  Wood allegedly wrote checks to himself and took union dues proceeds for his own benefit.  Read the story here.

Former Finance Executive In Texas Found Guilty on 39 Fraud Counts in $75 Million Ponzi Scheme

 Kurt Barton, 43, of Austin, Texas, has been found guilty on all 39 financial fraud felony counts filed against him for operating a Ponzi scheme that bilked investors out of $75 million.    Barton, the CEO of Triton Financial, raised investor funds ostensibly for real estate and businesses, as well as to make short-term loans to business owners.  Only about $20 million of the $75 million raised went for toward legitimate investments, the rest supported his lifestyle and paid for prior investors' purported returns.  Barton was convicted on one count each of conspiracy, securities fraud, 15 counts of wire fraud, five counts of false statement related to a loan and 17 counts of money laundering.  Read the story here.

Nevada Woman Sentenced For Embezzling $750K
Terry Straw, 58, of Sparks, Nevada, was sentenced to up to 10 years in prison for embezzling nearly $750,000 from Reno-Tahoe Construction Inc. where she had been employed as an office manager.  According to authorities, over a 5 year period, Straw siphoned funds from the company by writing checks to herself and doctoring invoices.  According to media reports, Reno-Tahoe Construction was forced to lay off 60 employees and nearly bankrupted the company.  Straw reportedly has a serious gambling addiction and spent much of the ill-gotten gains at local casinos. Connecticut Woman Charged with Embezzling Nearly $300K From Church

Kelly Saucier, 45, of Southington, Connecticut, has been charged with embezzling nearly $300,000 from the Plantsville Congregational Church where she had served as treasurer.  According to authorities, over a period of more than five years, from 2005 to December 2010, Saucier made over 100 unauthorized transactions siphoning church funds into her own accounts.  Authorities report that a total of $293,385.15 was allegedly stolen by Saucier.  Read the story here. 

Oregon Woman Sentenced For Embezzling Nearly $500K

Faye Louise Clemens, 65, of Beaverton, Oregon, has been sentenced to 52 months in prison for embezzling nearly $500,000 from Marine Lumber Co. where she had been employed as a bookkeeper.  According to authorities, Clemens wrote checks to herself for cash, pocketing the money over a period of three years.  Clemens has blamed her actions on an apparent gambling addiction.  Read the story here.
